Acceptable Use Policy

  1. Subscriber will adhere to this AUP and will not allow the Services to be used for activities prohibited by the AUP. SAIS may revise this AUP from time to time by posting a new version thereof on the SAIS Website, and Subscriber is responsible for awareness of and compliance with such revisions. In the event of any conflict between the provisions of the AUP and of this SAIS Agreement, the SAIS Agreement will govern.

  2. Dialup accounts may be shared within one household, one business or one immediate family only. Do not use other people's accounts. Keep your username and password confidential. You may not sell, lease, rent or assign an Internet connection or parts of the connection to any party without the express, prior, written approval of SAIS. You are responsible for all use of your account(s) and the confidentiality of passwords. SAIS will suspend access or change access to Customer's account(s) immediately upon notification by Customer that his/her password has been lost, stolen or otherwise compromised. SAIS is not liable for any usage and or charges prior to SAIS making the necessary account alteration.

  3. In its use of the Services, Subscriber will not (a) disseminate any unsolicited commercial e-mail messages (“Spam”); (b) engage in any activity advertised by, promoted by, or otherwise connected to Spam; (c) perpetrate any fraud or intellectual property infringement; (d) disseminate or post any material or information that is pornographic or may be abusive, threatening, libelous, obscene, harassing, or offensive; (e) perpetrate any crime or other illegal activity; (f) tamper with other SAIS accounts or commit unauthorized intrusion into any part of SAIS’s system; (g) perpetrate any security breach, network attack, denial-of-service attack, act of hacking, or distribution of any virus, worm, or other harmful code, or in any other way interfere with any individual’s or entity’s use or enjoyment of any computer or of the Internet; or (h) threaten or harass any SAIS employee, agent, or representative.

  4. Subscriber is responsible for maintaining on its own premises backup copies of any data stored on SAIS equipment. SAIS is not responsible for providing physical access to or copies of the software, data, or content stored on its equipment under any circumstances and is not required to provide network access (1) after any termination or suspension of Subscriber’s account or (2) in the event of hardware failure, abuse by hackers or other third parties, or other interruption of network access not resulting from SAIS’s fault. SAIS will not be liable for loss of data or for breaches in system integrity. SAIS may interrupt or suspend Services, remove any material or information in whole or in part, or terminate Services, immediately and without advanced notice, in the event that: (a) the Services or any related SAIS equipment has been breached by hackers or other unauthorized third parties; (b) use of the Services causes a denial of service or in any other way impedes a third party’s use or enjoyment of the Internet or injures the functioning of services SAIS provides to other customers; (c) Subscriber’s account is involved in a violation of the terms of Article IV (Acceptable Use); or (d) continuation of the Services exposes SAIS or its affiliates to liability. SAIS may furthermore interrupt or suspend services or remove any material or information in whole or in part, without advanced notice, in order to investigate any of the causes or concerns listed in the previous sentence. SAIS will have no liability to Subscriber for any such interruption, suspension, or termination of Services or removal of materials, even if hackers or other third party intruders are responsible, even if Subscriber is not at fault, and even if it is later determined that the suspected injury or violation did not occur.

  5. SAIS may interrupt or suspend Services, remove any material or information in whole or in part, or terminate Services, immediately and without advanced notice, in the event that: (a) the Services or any related SAIS equipment has been breached by hackers or other unauthorized third parties; (b) use of the Services causes a denial of service or in any other way impedes a third party’s use or enjoyment of the Internet or injures the functioning of services SAIS provides to other customers; (c) Subscriber’s account is involved in a violation of the terms of this Acceptable Use Policy; or (d) continuation of the Services exposes SAIS or its affiliates to liability. SAIS may furthermore interrupt or suspend services or remove any material or information in whole or in part, without advanced notice, in order to investigate any of the causes or concerns listed in the previous sentence. SAIS will have no liability to Subscriber for any such interruption, suspension, or termination of Services or removal of materials, even if hackers or other third party intruders are responsible, even if Subscriber is not at fault, and even if it is later determined that the suspected injury or violation did not occur. Subscriber will inform SAIS promptly after discovering that any hacker or other unauthorized third party has accessed the Services through Subscriber’s account.

  6. You are responsible for notifying SAIS when you wish to terminate your account service. There are no refunds for time not used on your account. It is your responsibility to cancel your account or Email us at: computers@straitsarea.com or contact us at (231) 627-9016.

  7. All Internet protocol (“IP”) addresses provided to Subscriber through the Services are licensed at SAIS’s sole discretion, and Subscriber has no right to continued use or any use of any IP address

  8. In reporting any alleged infringement of intellectual property rights, Subscriber will adhere to SAIS’s then-current Digital Millennium Copyright (“DMCA”) policy (posted here). If Subscriber is suspected of violating third-party intellectual property rights, Subscriber will fully cooperate with SAIS in any investigation thereof, will provide all information requested, and will otherwise adhere to SAIS’s DMCA policy.

  9. SAIS may grant law enforcement agencies access to its equipment to monitor Subscriber’s use of the Service. The law requires SAIS to report any illegal activities that it becomes aware of to the appropriate authorities.

  10. No software may be installed on, or compiled on any SAIS server without prior explicit written permission.

  11. The use of any unattended connection software (such as Connection Keeper) is prohibited.

  12. Subscriber will not permit any third party to use the Services for any of the activities prohibited by this AUP.
